Consumer Insurance Contracts Act 2019 (CICA)

CICA is a significant focus for Capital Insurance Markets and we have a cross-function project team in place to robustly consider its impact on our activity. This will involve analysis and where required, remediation to various work practices and documentation, to ensure compliance with CICA, throughout the next 12-18 months.

We are working in close collaboration with our panel of insurer partners. We are reliant on these partners to provide us with amended insurance documentation including policy wordings, schedules, proposal forms/statement of fact, which comply with the legislation. Given the scope of the requirements, insurers have indicated it may take up 18 months to meet the full requirements of the legislation, in terms of consumer documentation. As an interim measure, insurers will likely provide inserts for inclusion in documentation reflecting the legislative requirements and these will be provided to our broker panel on a case by case basis as required. It remains our preference to use digital communication rather than printed hard copy in line with our ongoing work to reduce our carbon footprint.

It is likely that we will contact our customers slightly earlier in the renewal cycle where any pre-renewal detail is required to allow insurers consider underwriting detail and to set premium rates. This is in line with S174 requirements. We would appreciate your support in ensuring that any such pre-renewal information is submitted in good time. Unfortunately, failure to provide such information may result in renewal terms not being offered and the policy lapsing.

We will continue to provide updates as they become available. If you have any queries, please direct them to our compliance team at compliancedept@capitalim.ie and we will aim to respond to you within 5 working days.

Thank you for your continued support.
